Municipality Emmen: Legal Framework

Selected industrial sites, their businesses and the Municipality of Emmen pilot the best-fitting legal and regulatory option for the chosen business model and technical solutions. The findings in this collaboration can be used to adjust and improve related legal and regulatory options. Additionally, it informs the recommendations on (inter-)national legal frameworks and demonstrate how - notwithstanding the current frameworks - more is possible then many stakeholders are aware off. 

Emmen investigated the legal possibilities for renewable energy exchange between GETEC.PARK Emmen and the company Berton Beton. This looked at the upcoming Energy Act and European laws and regulations around energy communities. This involved looking at the consequences for the network connection of both companies and the effect on the network in general. A highlights document and the report of the study are attached, covering:

  1. Threats and (legal) opportunities of Energy Communities in Dutch Context
  2. PV-installations on the roofs of a neighbouring company to produce electricity for the own GETEC installations (and clients)
  3. Can GETEC use these installations to supply electricity to Berton Beton?
  4. And if so, how can the network/grid capacity that would become available be used on-site?
  5. How should the pricing of business-to-business electricity supply be?
  6. Conclusions
